Since December 2024, in Belgium, anyone who sells sexual services has the right to an employment contract, paid holidays, insurance coverage, and pension contributions. This is not a symbolic extension. It is the full application of labour law to an activity that most Western countries continue to regulate through the criminal code.

The map published by Geo Mapped on Instagram in July 2026 shows Europe split into three colors. The green of full legalization covers Belgium, Germany, the Netherlands, and Austria. The yellow of partial legality extends to Spain, Italy, and the United Kingdom. The red of near-total prohibition covers the East and the Nordic countries.

It is not a static snapshot.

What moves beneath the surface is a clash between two incompatible ethical models. Those who work in the sector have known it for years, but seeing it translated into law still has quite an effect.

The Belgian choice did not come out of nowhere. It is the endpoint of a union mobilization involving collectives of sex work, labour lawyers, and human rights associations. The law recognizes sex workers as self-employed or employed workers, depending on their relationship with the employer. And it requires venue managers to provide safety conditions, anti-assault alarms, and access to health services without mandatory reporting.

Those who followed the Belgian parliamentary debate remember the resistance. The same resistance that surfaces in every country when the discussion leaves the frame moral frame and lands on concrete law. The question detractors asked was whether the State could ever legitimize the buying and selling of physical intimacy without selling out human dignity.

The promoters responded with another question: what dignity does a worker without a contract have?

The Nordic model and its cracks

There has been a social experiment underway in Northern Europe for twenty-five years. Sweden launched it in 1999: punish those who buy sex, not those who sell it. The stated goal was to eliminate demand in order to extinguish supply. The so-called Nordic model has been adopted by Norway, Iceland, France, Israel, and Canada. The underlying idea, which has its own progressive appeal, is that prostitution is always and in any case a form of gender violence.

The results are more ambiguous than governments admit.

A study published in Journal of Sex Research has highlighted that in Sweden street prostitution has actually decreased, but online prostitution has increased proportionally. Undocumented immigrant sex workers have become more vulnerable to abuse, because they cannot report without risking deportation. And violent clients encounter fewer obstacles when they know that contact with law enforcement is out of the question.

Belgium chose the opposite path. Instead of removing the phenomenon by law, it tried to regulate it down to its material roots. Those who have worked on it for years — health workers, lawyers, activists — consider it a paradigm shift more than a technical reform.

In the document published by ETUI in February 2026, researchers emphasize that Europe remains divided not only over rules, but over language itself. In some countries the term “sex worker” does not exist in official texts. There is only talk of “prostitutes” or “victims of exploitation.” In Belgium, by contrast, the law explicitly adopts the term “sex worker” and distinguishes voluntary activity from criminal exploitation.

Sex work, not prostitution

The distinction is not semantic. Calling those who offer paid erotic services “sex workers” means recognizing that there is a space for agency in sexuality, even when the primary motivation is economic. It does not imply that everything is all roses. It implies that the law can protect workers without infantilizing them.

Estimates from the World Health Organization indicate that in countries with repressive laws, sex workers have a rate of sexually transmitted infections two to five times higher than in countries with regulation. The reason is banal: where the activity is illegal, health checks are hindered and workers avoid public services for fear of being reported or stigma and sexuality rooted.

Belgian law provides that every registered sex worker has access to free screening, without obligation to communicate their real name to the national health system. A detail that seems bureaucratic, but in practice saves lives.

Japan, which also often appears in rankings of countries where prostitution is de facto tolerated, offers an opposite example. The law prohibits paid vaginal penetration, but leaves room for any other type of erotic exchange. The result is a galaxy of “soapland,” clubs, and services operating in a legal gray zone, without contracts or welfare rights. It is not a model, it is a misunderstanding prolonged for decades.

Safety and consent are not a given

A work contract does not turn sex into a neutral service. But it makes it possible to say no without losing the week's income. Under Belgian law, refusing a client or a specific practice can never be grounds for dismissal or retaliation. There is a clause that prohibits employers from imposing services that were not agreed upon and requires venues to equip themselves with emergency buttons connected to law enforcement.

Those who have practiced consent dynamics in the context of BDSM knows full well that consent is never an authorization given once and for all. It is a negotiated process, revocable at any moment. Extending this awareness to sex work means recognizing that safety is not an optional extra, but the minimum infrastructure of any erotic relationship, even and especially when it is mediated by money.

Not all Belgian sex workers are enthusiastic. Some prefer to remain invisible to tax authorities. Others fear that the national register of sexual services, however anonymized, could become a tool of police control in the future. Are these fears well-founded? Only time will tell.

Meanwhile, organizations such as UTSOPI and Espace P continue to offer free legal assistance to workers who want to exit the informal regime. Registration in the register is not mandatory. It is an option. And this is perhaps the most debated point of the reform: it does not impose, it proposes.

Sources and references

Sources:

Geo Mapped – Countries Where Prostitution is Legal 2026 (Instagram)

World Population Review – Countries Where Prostitution Is Legal 2026

ETUI – While Belgium passes groundbreaking legislation for sex workers, Europe remains divided on the issue (2025)

The Kinsey Institute – Sex Work and Policy Research

World Health Organization – Sex Workers Health and Human Rights

La notizia è arrivata in sordina, sepolta tra le pieghe dei quotidiani economici.
